Activist federal judge ignores the Constitution, strikes down Pa. ban on homosexual marriage

HARRISBURG - A federal judge on Tuesday struck down Pennsylvania's ban on same-sex marriages, a landmark ruling that could clear the way for the Commonwealth to become the 17th state to legalize gay marriage.

The decision by U.S. District Judge John E. Jones III marked the first and most significant to date in a series of court challenges to the state's 1996 ban.

It was not immediately clear if Gov. Corbett, whose administration had defended the law, would appeal the decision.

The lawsuit, Whitewood v. Wolf, was brought by 23 plaintiffs who said Pennsylvania's law violates the state constitution by excluding same-sex couples from the same legal benefits and protections as heterosexual couples.

He also fails to realize that the federal government is NOT in the marriage business. That is a power reserved specifically for the states.

What a crock! Landmark in what way? Landmark would have been to stand up for the US Constitution, instead of joining the slew of black robed tyrants who suddenly decided the constitution means something in never, ever met before.

The 17th state to legalize gay marriage? The state isn’t doing this! Again, this is being imposed on the state.

Don’t act like this is some glorious will of the people, Amy Worden! You’re just happy this judge CRUSHED the will of the people, because you don’t like democracy.

...who said Pennsylvania's law violates the state constitution by excluding same-sex couples persons who don't have the skills to perform brain surgery from the same legal benefits and protections as heterosexual couples persons who do have the skills to perform brain surgery.

In other words, the judge misinterprets the principle of equal protection, and thereby outlaws all state licensing of anything.

If I understood Mark Levin correctly, the state legislature has the final legal authority. Exert your Constitutionally granted powers Governor! No more kow towing to the satanic left.

For decades I’ve heard Republican leaders decry judicial tyranny and judicial activism. Heard them at conventions, on the floor of the House, in speeches, on radio interviews, etc.

So here’s a prime example, in which GOP leaders should be chewing and spitting nails. A total obliteration of the rule of law. The Constitution being rendered nothing more than toilet paper. Yet, where are the loud voices of Republican opposition? Have they just totally surrendered every single belief and every single value they had? Or did they not have them to begin with, and I’ve been a absolute, naive idiot for ever believing them about anything? Is the GOP, in the final scheme of things, just as evil and degenerate as the Dems?

I can say with utmost confidence that my PA state rep Daryl Metcalfe, a very stanch and unapologetic traditional marriage advocate, will go the mat and do everything in his power to fight this tyrannical court decision.

The judge fully understand the concept of the “living Constitution” which is being taught in law schools today. The philosophy of “original intent” will be gone forever as soon as Scalia, Kennedy, Thomas or Alito is replaced with another Sotamayor.
