Judge awards frozen embryos to 42-year-old doctor who froze fertilized eggs with boyfriend

A judge is siding with a Chicago woman seeking to use frozen embryos to have a child over the objection of her former boyfriend.

Karla Dunston was diagnosed with lymphoma four years ago. Knowing chemotherapy would make her infertile, she had embryos frozen before treatment.

Her then-boyfriend, Jacob Szafranski, provided the sperm. They broke up a year later and Szafranski changed his mind, leading to a lengthy court battle.

The way I see it, he may not want children, but he has children. Maybe very very very very young children, to the nth degree, but still children, as just watch.

Boyfriend engaged in an act of procreation, albeit novel, the effect of which was merely delayed. She exercised her option to continue the pregnancy. He can’t make her NOT exercise the option any more than he could compel her to have an abortion.

Unless he had a contract in advance relieving him of financial responsibility, he is going to be a daddy with all of the obligations that entails. Even if he did have such a contract, I don’t think a judge would uphold it because there will be a child now who is biologically his and who will need support.

Caveat emptor.

This man chose to create the embryos. Now that they exist, he has no right to demand that they remain frozen and finally die because he has decided he doesn’t want them after all.

This man chose to create the embryos. Now that they exist, he has no right to demand that they remain frozen and finally die because he has decided he doesn’t want them after all.


So using your opinion, this guy could also petition to have the embryos adopted out to a 2 parent mom and dad married couple who wants children.

The ex-girlfriend forcing this man to be a father to children he doesn’t want is cruel to the children.

The ex-girlfriend is being very selfish. Not surprising when making embryos while not married is selfish.

Many IVF babies die in utero, especially if they’ve been frozen. Maybe the guy will get lucky. (s)
