Brady Center lawsuit to use “smart” gun mandate to trigger handgun ban in New Jersey
The Washington Post's The Volokh Conspiracy ^ | May 22, 2014 | David Kopel

Early this month I wrote about New Jersey’s “smart” gun mandate. The statute bans the sale of all ordinary handguns in New Jersey within 30 months of the date when “at least one manufacturer has delivered at least one production model of a personalized handgun to a registered or licensed wholesale or retail dealer in New Jersey or any other state.” N.J. Stats. sect. 2C:58–2.2 et seq. A so-called “smart” gun is one with some kind of technology such that only the owner is supposed to be able to fire it. As detailed in my previous post, American police and other citizens appear to have very little interest in such guns, in part because of reliability problems.

The 30-month countdown to the ban on handgun sale is triggered by a report from the New Jersey Attorney General:

2. a. On the first day of the sixth month following the effective date of P.L.2002, c.130 (C.2C:58-2.2 et al.), the Attorney General shall report to the Governor and the Legislature as to the availability of personalized handguns for retail sales purposes. If the Attorney General determines that personalized handguns are not available for retail sales purposes, the Attorney General, every six months thereafter, shall report to the Governor and the Legislature as to the availability of personalized handguns for retail sales purposes until such time as the Attorney General shall deem that personalized handguns are available for retail sales purposes and so report to the Governor and the Legislature. In making this determination, the Attorney General may consult with any other neutral and detached public or private entity that may have useful information and expertise to assist in determining whether, through performance and other relevant indicators, a handgun meets the statutory definition of a personalized handgun set forth in N.J.S.2C:39-1....

Most idiotic thing ever. Within 3 days of introduction a smart gun will be hacked, no doubt. Also a patent has already been filed for a smart gun kill switch, so if you posses one of these guns for protection from a tyrannical government you have already lost. Smart gun, dumbest thing ever. Liberals project names that are the antithesis of reality, opposite world; see “affordable care act”

Someone a few months back posted an article about a biometric smart gun finally being produced, commercially. I was shocked to find no mention in the replies of this NJ law, so I mentioned it... and here it is... and here I am saying, “I told ya so”.

I had attended engineering school in NJ, and the junk mail they send me had a writeup a few years ago how they were receiving grant money to use for research to produce this technology. It just reinforced my stance to never, ever donate a dime to that school or its alumni association.

FUNJ.

Are you sure about that?

And besides, all a patent can do is to PREVENT others from using the invention, so I don’t see how “patent filed” (if true) should be a threat to our liberty.

If I was faced with this law, I would FLAGRANTLY disobey it, and I would kill anyone who tried to stop me.

So the Gov will keep raising the bar, boiling the frog. Next there will be
legislation that handguns must have removable firing pins that must be stored
a min of 1000-yards from the actual location of the weapon. And the firing pin
must be stamped with the persons Name, Address, Phone number, Mother maiden name,
Fathers full name, SS#, and Date of birth.

Guess you don’t know anything about Dave Kopel, do you? He’s one of the most pro-gun researchers there are and the Cato Institute is pro-freedom! Guess you need a clue????

No. Is she related to Dave Chapelle?

The “smart gun” is the dumbest idea ever to come along.

The only one who can fire it is the certified owner of the gun. This can be done by wearing a bracelet or by fingerprint identification.

Now, take this scenario: You wake up at night and there is an attacker standing over you (or in your room). Do you ask him to wait to attach while you put your bracelet on or worse yet, ask him if he can open the gun safe and give you your gun so you can protect yourself? How STUPID!

Next, You are gone from your home and your wife or child is attacked. Do they call you so you can come home to operate the “safe pistol” or do they use the pistol as a club to try to protect themselves? What if they don’t have the combination to the gun safe?

The most horrible thought is “what if the battery is dead!” Imagine your family is dead or abused simply because the battery is dead. Worse yet, you are dead because of a watch battery that is dead.

The “chicken littles” of gun control cannot even envision the fact that when you are in need of a gun for protection...IT IS IMMEDIATE; not something you have plenty of time to “fiddle around” with to actually have it in hand and ready to use.

We had gun control when I was a boy back in the 50’s. It was called RESPONSIBILITY and COMMON SENSE.

The rules were simple:

Obey the law.
Always assume the gun is loaded.
Don’t point a gun at anyone even though you think it is unloaded.
Know what is behind your target.

And........if you violate any of these rules Daddy is going to kick your ass!
