Post #20 is the thread winner.

What had the potential to be a landmark decision ended up being a small case of statutory construction. Chief Justice Roberts, ever the minimalist, read into the Chemical Warfare Treaty Act an implied exception for traditional state crimes. This allowed him, along with a majority of the Court, to avoid having to make a Constitutional ruling. At least he didn't convert the Act into a tax on chemical weapons.

I meant to write that Scalia, Thomas, and Alito found the Act UNconstitutional under the 10th Amendment.

So we have three good justices, two traitors who sometimes do not act like idiots, and four idiots? I hate to say it, but this makes the court better than either House of Congress, or the executive branch.

Good analysis. Congress is clearly well beyond the vision of the Founders. Bammy and the bureaucracy are clearly traitors all. The intellectually lazy Congress has given up their power.

The wording of the title got me down as it implys congress can simply legislate away the 10th amendment at will but choose not to.

No we diden’t win one. The federal employees simply pointed out that the act the Federal injustice department charged the woman with violation did not apply to her crime.

She didn’t uses chemical weapons as defined by the act.
