The top-ranking US military officer has raised the possibility Sgt Bowe Bergdahl could be prosecuted if he abandoned his post before his capture.

Gen Martin Dempsey wrote Sgt Bergdahl, 28, "is innocent until proven guilty".

But he said the Army would not dismiss "misconduct if it occurred".

Meanwhile, US President Barack Obama defended his decision to free five senior Taliban leaders to secure Sgt Bergdahl's release on Saturday after five years in Taliban captivity.

'No conditions' In Warsaw, Mr Obama said the US had a "pretty sacred rule" not to leave soldiers behind, arguing that the most important consideration was to bring home a young American held captive for five years.

"We don't leave our men or women in uniform behind and that dates back to the earliest days," Mr Obama said at a news conference. "Regardless of the circumstances, whatever those circumstances may turn out to be, we still get an American soldier back if he's held in captivity. Period. We don't condition that."

Since Sgt Bergdahl's release on Saturday, a growing chorus of opposition Republicans have criticised the president's decision to order the prisoner swap.

They have attacked the president for undertaking what they describe as negotiations with terrorists, and say the transfer of five Taliban senior prisoners from the detention facility at Guantanamo Bay, Cuba, to Qatar, puts Americans at risk.

how about a court martial ? there already has been a Pentagon investigation of bergdahl done in 2010

Imagine for the moment that you are a General in the U.S Army. You find yourself in the position where you get to make the decision as to whether on not there will be a Court Martial. Imagine that you get a visit from an Obama staffer of reasonably high level who mentions that the President would not look favorably on a decision to hold Bowe Bergdahl accountable even he is guilty of desertion. Five years, blah, blah, blah. Presidents reputation, blah, blah, blah.

Question: What would you do?
Question: Is there any doubt that this scenario will take place in the future if it hasn't already?

Kinda puts the kibosh on 0bama having a big fete for Bergdahl at the WH with a bunch of celebrities there, promoting his heroism and bravery, right? Now, it will have to be a low-key deal, and the invite list will be cut back to just a close group of Muslims.

The UCMJ is a voluntary agreement that all soldiers agree to when enlisting. It does NOT offer the same constitutional protections that civilians have.

Don't expect anything to come from this, unless Dempsey is looking for a spot under the bus. Prosecuting Bergdahl would make Hussein look like the communist traitor he is, so Dempsey will get the word to shut up. End of story.

I’m aware of that, as I served a career in the AF. But prosecution of Bergdahl will not happen so long as Obama sits in the WH.
