Looks like it touches on moral questions, dealt with also in the battle over government power.
If the goal is the maximum immediate convenience of the maximum number of people, there is little justification for patents. Or, arguably, restriction on government power.
But if the goal is to avoid violating God’s will in “Thou shalt not steal”, that will lead to much different economic arrangements.
