Ted Cruz: Ban transfer of Gitmo detainees
Politico ^ | 6/9/14 | BURGESS EVERETT

Posted on 06/09/2014 6:52:52 PM PDT by SoConPubbie

Ted Cruz began on Monday shopping his bill to temporarily ban the transfer of Guantanamo Bay detainees, arguing it’s “prudent” to halt such transfers while the deal to release Sgt. Bowe Bergdahl is still being examined.

The Texas Republican said his legislation, expected to be introduced on Tuesday, would freeze government funding for Guantanamo transfers and deduct any money used for such transfers from the executive office of the president. There would be an exception for the release of individual prisoners if President Barack Obama asks Congress.

Cruz’s bill would also require that every Guantanamo release be personally approved by the president.

“Until President Obama can make his case and convince the American public that this swap was in our national interest, prudence dictates that all further transfers and releases from Guantanamo Bay should be off the table,” Cruz said on the floor on Monday afternoon.

It will be difficult for Cruz to draw any Democratic sponsors to his legislation given that it will be seen as an attack on Obama’s autonomy. And Cruz clearly means to take on the White House, arguing that the deal to secure Bergdahl’s release has made the United States less safe by also releasing five senior Taliban officials.

“We cannot know for sure how many American soldiers paid the ultimate price to capture these five senior terrorists. Even as many other detainees at Gitmo have been released, up until now these five have been considered too dangerous to let go. Given the level of threat they represent, any proposal to release them should be of the utmost seriousness,” Cruz said. “Unfortunately, by all indications, the administration’s release treated their threat as anything but serious.”

Cruz is a member of the Senate Armed Services Committee, which will receive a closed-door briefing from top Obama administration officials on the Bergdahl swap on Tuesday morning.

0 is just trying to release all of the terrorists for his MB buddies. I wonder how many secret bank accounts he has to accept money from Soros, the MB, and those he does certain favors for not counting the blackmailees.

“it will be seen as an attack on Obama’s autonomy.”
Autonomy? Obama is the most DISENGAGED president we’ve ever had. Refusing to get congressional approval, not even dropping a CLUE about his intentions, breaking the law, treasonous activities - and they’re worried about his autonomy? Sheesh.

We already have a law banning the transfer of detainees:
the National Defense Authorization Act, 2014.

Sec. 1033.
Requirements for certifications relating to the transfer of detainees at United States Naval Station, Guantanamo Bay, Cuba, to foreign countries and other foreign entities
(a)
Certification required prior to transfer.—
(1)
In general.—

Except as provided in paragraph (2) and subsection (d), the Secretary of Defense may not use any amounts authorized to be appropriated or otherwise available to the Department of Defense to transfer, during the period beginning on the date of the enactment of this Act and ending on December 31, 2014, any individual detained at Guantanamo to the custody or control of the individual’s country of origin, any other foreign country, or any other foreign entity unless the Secretary submits to Congress the certification described in subsection (b) not later than 30 days before the transfer of the individual.”

So we’re going to `reinvent this wheel,’ like “comprehensive immigration reform”?
Just enforce the law we have that Obama broke.
Do you think he’ll have any more respect for `old wine in a new skin’?
Enforce the law, or just admit that the executive branch is above the law.

What good did it do to kill Bin Laden if we were going to release 4 of his henchman to take his place?

No Ted, impeach Obama. He broke the law that you passed and that he signed? Think of the country for once Ted, not your career?

“...of the utmost seriousness...”

Imagine the release of the 5 from GITMO that has already taken place.

Imagine the missing commercial airline 777.

Imagine the BenghaziBarrySoebarkah regime needing another “distraction”.

Imagine our military NOT wanting to fire on a commercial airline that is flying unexpectedly into air space not documented beforehand.

Imagine the “missing” plane having been outfitted with bombs.

Excellent idea! That expeditiously solves the problem of those mooselimbs at Gitmo. Truth be told, I'd prefer to expand the scope a bit since this map shows a clear and present danger infesting a good part of America:

“Taliban Mullah in Chief” Hussein Obama has chosen “Secretary of Defending the Taliban” Hagel to continue to make Grand Bargains with Gitmo Prisoners so that Gitmo can be closed on the last day that all US Military Personnel finally abandon Afghanistan to the Taliban.

funny Ted thinks passing a law will change this corruption.

Funny, you seem to be kind of ignorant of the kind of man Ted is.

Much like our founders, he, and they, chose to go through the legal channels that were/are available at the time. Only when those have all failed, are the other options on the table.

So, when Ted does what you want him to do, and the cowards in the Senate and the House don't follow his lead, what next?

So, when Ted does what you want him to do, and the cowards in the Senate and the House don't follow his lead, what next?

So when the cowards in the Senate or House don't follow his lead, they are proven to the electorate to BE cowards. The public, if they are not ignorant or cowards themselves, can dump the career politicians at the next election.

This dilemma is the best argument that term limits are necessary....

not ted the people that will execute the law. they can pass millions of em. if the current POTUS and congress doesn’t enforce them then we are a lawless nation. The founders knew that our government would only work if honest, god fearing, high integrity people voted and then were elected to carry out the laws. absent honesty, integrity and God, there is no law. period.
