A Los Angeles Superior Court judge ruled Tuesday that teacher tenure laws deprive students of their constitutional right to an education, a decision that hands teachers unions a major defeat in a landmark case that overturns several California laws that govern the way teachers are hired and fired.
Substantial evidence presented makes it clear to this court that the challenged statutes disproportionately affect poor and/or minority students, Judge Rolf M. Treu wrote in the ruling. The evidence is compelling. Indeed, it shocks the conscience.
The ruling, which declared the laws governing how teachers are hired and fired in California to be unconstitutional, is likely to set off a slew of legal fights here and in other states, where many education reform advocates are eager to change similar laws. The ruling brings a close to the first chapter of the case, Vergara v. California, but both sides have made it clear that they plan to appeal any decision that goes against them to the State Supreme Court.

Yes, but collective bargaining contracts must be consistent with federal and state laws.
K-12 Michigan teachers have no tenure.

One Gazzillion percent it will be overturned. But now that the decision has been handed down, can it not go all the way the the Supreme Court?

I live in CAL and I was surprised how evenhandedly the leftwing media have reported this story. They actually showed interviews with the people suing the unions. They even said that one of the candidates for State Sup of Education opposes tenure while the incumbent is ‘strongly backed’ by the teachers’ unions. You could have knocked me over with a feather.
That being said, the government unions have an iron hold on the state government from Gov Moonbeam all the way down to the local school boards. Even if this case is upheld by the courts, the schools will just ignore it like they do Prop 209, the CA initiative that prohibits skin color based discrimination.
I always get out and vote and contribute what I can to conservative candidates but CA is pretty much a basket case. Someone here mentioned that Michigan has dropped tenure and we all know Scott Walker’s efforts in Wisconsin against the unions so there is definitely hope in other states.
