Justina Pelletier belongs with her family, Massachusetts DCF says in legal motion

The fate of a 16-year-old Connecticut girl at the center of a major medical custody dispute is in the hands of a Massachusetts judge, now that Bay State children's advocates have conceded Justina Pelletier should be returned to her family.

In a controversial move, Pelletier was placed in the custody of the Massachusetts Department of Children and Families more than a year ago, after two reputable Boston hospitals sparred in their diagnosis of the girl.

In what Justina's attorneys are calling a "dramatic reversal," the Massachusetts DCF filed a motion agreeing that the teenager should be returned to her family. Alec Loftus, a spokesman for Massachusetts Health and Human Services Secretary John Polanowicz, confirmed to FoxNews.com Wednesday that both parties are in agreement.

"We are pleased that the family has engaged around the reunification plan and we have filed papers in court to support our shared goal of bringing Justina home," he said in an email.

Attorneys representing Justina filed a subsequent motion Tuesday requesting that Johnston expedite a ruling "because all parties are in agreement," said Mat Staver, founder and chairman of Liberty Counsel, which represents the Pelletier family.

You just have to wonder if the DCF folks all of a sudden see the handwriting on the wall? I just hope that the Pelletiers launch the mother of all lawsuits against the DCF and Boston Children’s just as soon as the illegal custody by the DCF is vacated. If she were my daughter, i’d spend every last available dime I could muster suing everyone involved. Like the VA, people here need to be doing jail time for this outrage.

Backstory in this case, IIRC, is that the parents have another child that had been diagnosed with this Mitochondrial Disease (whatever that is) and they had been able to deal with it. These things are touchy, but it all comes down to the fact that it is not the role of the state, or the medical industrial complex to take care of children. It does not take a Village... it takes a mother and a father.

It was a single person who had an agenda....not some “medical industrial complex”. The facts in this case and others that this one person is responsible for destroying should have their license pulled and never be allowed near a hospital again. It is criminal evil

The real back story on this is that it isn’t an isolated case at Mass Children’s. That hospital has done the same thing to multiple families over the past few years. Something weird going on in their psych department. They need to be used, because it is the only thing that will stop them.

I am assuming you mean “sued”?
Yes .. they do. But in MA the patient is assumed crazy until they can prove that they are actually “sick”.

Then the psych diagnosis goes on your record and no one will treat you because you are “delusional”… it’s MGH’s favorite diagnosis!
If your illness does not have an insurance “code”..you in turn become crazy.

I have a friend from upstate New York with a neighbor that took their kid to Mass Children’s for a psych issue. The girl was in the hospital for less than 48 hours when the parents were kicked out of the hospital and told they had lost custody of their child. Just like this case, the judge put a gag order on the parents. The family got around it by having the grandfather approach the local media/politicians. It took 70 days to regain custody.
