Madison Prosecutors allege that Gov. Scott Walker was at the center of an effort to illegally coordinate fundraising among conservative groups to help his campaign and those of Republican senators fend off recall elections during 2011 and '12, according to documents unsealed Thursday.
In the documents, prosecutors lay out what they call a "criminal scheme" to bypass state election laws by Walker, his campaign and two top deputies R.J. Johnson and Deborah Jordahl.
The governor and his close confidants helped raise money and control spending through 12 conservative groups during the recall elections, according to the prosecutors' filings.
The documents include an email in which Walker tells Karl Rove, former top adviser to President George W. Bush, that Johnson would lead the coordination campaign. Johnson is also chief adviser to Wisconsin Club for Growth, a conservative group active in the recall elections.
"Bottom-line: R.J. helps keep in place a team that is wildly successful in Wisconsin. We are running 9 recall elections and it will be like 9 congressional markets in every market in the state (and Twin Cities)," Walker wrote to Rove on May 4, 2011.
A federal judge unsealed the court documents Thursday as part of a lawsuit attempting to halt the secret investigation into the so-called John Doe probe into the recall elections.
The lawsuit was brought by Wisconsin Club for Growth and one of its directors, Eric O'Keefe. They allege the probe has violated their First Amendment rights to free expression and persuaded U.S. District Judge Rudolph Randa to halt the investigation, at least for the time being.

The judge had already seen the emails, and his ruling found that the coordination -- to the extent that it even existed -- did not violate the law.
Remember this suit was brought by supporters of Walker. They wanted the documents to be unsealed because they were being subpoenaed to produce evidence by the Secret Prosecutors on the basis of secret evidence.
Attorneys for Wisconsin Club for Growth said it was prosecutors who had violated the state’s election laws.
“These documents show how the John Doe prosecutors adopted a blatantly unconstitutional interpretation of Wisconsin law that they used to launch a secret criminal investigation targeting conservatives throughout Wisconsin. That legal theory has now been rejected by two courts,” said Andrew Grossman of Baker Hostetler, the law firm representing Club for Growth. “Sunlight is the best disinfectant, and this is a story that needs to be told to prevent more abuses and to hold the John Doe prosecutors accountable for violating the rights of Wisconsinites.”

Wait a minute. Didn’t I read not too long ago that a judge angrily dismissed the prosecutors and all of their “evidence” re: Gov Walker?

One of the primary motivations of the IRS targeting was to coordinate with the DOJ to prosecute conservative activist groups.
They are dropping the veil. I wonder daily whether we’ll resolve this without bloodshed.

Imagine how differently the headlines would read if this had involved Republican prosecutors making legally baseless allegations about a Democrat governor in order to investigate liberal groups.
A mere five months later, the general election was a cakewalk for Barack Obama.
