Gay Marriage Bans Struck Down in Utah and Indiana by Federal Court

Utah and Indiana became the latest U.S. states to see their bans on same-sex marriage struck down following separate rulings in federal court on Wednesday.

"It is wholly illogical to believe that state recognition of love and commitment of same-sex couples will alter the most intimate and personal decisions of opposite-sex couples," a three-judge panel in the Utah case said while upholding a lower court ruling, NPR reported.

Back in December, Utah briefly became the 18th state where gay couples received the right to marry, after a federal district judge ruled that the state's same-sex marriage ban was unconstitutional. The decision was then put on hold pending appeals, though more than 1,300 gay and lesbian couples managed to get married before that.

Wednesday's decision, which resulted from a 2-1 split decision, has been put on hold, pending appeal which could go directly to the Supreme Court.

In Indiana, District Judge Richard Young, who also upheld a lower court ruling, added: "Same-sex couples, who would otherwise qualify to marry in Indiana, have the right to marry in Indiana. ... These couples, when gender and sexual orientation are taken away, are in all respects like the family down the street. The Constitution demands that we treat them as such."

Indiana Attorney General Greg Zoeller has filed a notice of appeal and an emergency request for a stay of Young's order, The Courier-Journal reported.

We must have a constitutional amendment requiring legal government marriage to be ONLY between one man and one woman.

Sure, take it to SCOTUS. But in the meantime get an order restraining this ruling. If not, nullify.

Federal acts and rulings like these that are flatly, blatantly, and egregiously unconstitutional need to be nullified and discounted by the states. It's time for the states and the people to assert their God-given rights and freedoms as protected by the Constitution and affirmed by the Tenth Amendment.

It's hard to believe there are that many screwed up people in a single state.

Still, my gadget says Utah has 2.8 million people, so as a percentage, most are normal.

Any government that is so depraved as to equate two dudes shacked up and playing in each others poop as being the equivalent of a “husband and wife,” is a government that doesn’t merit any legitimacy whatsoever.

Ignore the federal courts. Obama does. Besides, what good is federalism, if states can’t make their own choices based upon what their citizens vote for?

Why even bother with voting on propositions at the state level, when a federal court can just smack you down at their leisure? Why even bother with state elections, or even state governments for that matter? The states roll over and do whatever the feds tell them to do anyhow, and not one of them ever push back. 10th amendment? Not anymore.

Indiana and Utah should shut down their marriage license offices and tell the feds to start running them. If marriage is not a state function, get out of that business.
