Even if passed I’m pretty sure SCOTUS would have done the same thing, except this time on 1st Amendment grounds.

I'm not so sure about that. Remember, Scalia wrote the majority opinion in Employment Division v. Smith.

I’ll have to look at that case and see how it relates to the question presented in Hobby Lobby.
That said, I maintain that the original four who found the ACA entirely unconstitutional will all rule against it in each case where it is challenged.
I just don’t see a justice who finds the whole law repugnant actually siding with the government in any litigation surrounding the law.
We will see.
