Neither. Split in circuits both are controlling in their area. Most likely with that, unless both cases get appealed to the full Appeals Courts first (en banc — all the justices), the SCOTUS will sort it out.

SCOTUS may require en banc decisions first or just take the case to resolve the conflict.

I believe the confusion on the DC findings was that it came from a three judge panel, and not the full circuit. I believe the Regime will appeal for a full hearing by the DC circuit, where they believe the original decision will be reversed. Either way, the real intent of the ACA was creating chaos to usher in universal, state controlled health care.
