All sorts of things can be done on one side of an issue, all the way to the other side of an issue ... but if nothing is brought to court, nothing happens and nothing is decided and no precedent is set for future issues of a similar nature.
Court action is mandatory for future precedent.
War is a different state of affairs. And treasonous speech does not become non-treasonous merely because of non-prosecution.
