Actually, why bother to shoplift? Just go in and act suspiciously like a shoplifter, wait to get pinched (or questioned), and then file a complaint and negotiate a settlement.

I think you are right. They can go in there, act suspiciously, claim racism, and cite this settlement that this place has a documented history of racism. Shake down target, sad to say.
