You're right, except Scotus disagreed in 1969.

The Warren court determined another black demagogue scumbag, Rangel's predecessor, from Harlem by the name of Adam Clayton Powell could not be turned out of the House.

The situation was not identical to Rangel's, who was not denied a House seat.
