The court is not forcing the DOJ into releasing the documents themselves, the court is demanding they release the Vaughn Index of the documents they are withholding, along with a legal justification for the need to not release the documents.

If you are legitimately withholding documents, the Vaughn Index is your friend, if you are obstructing justice or trying to cover up wrong doing by not producing documents, the Vaughn Index is your worst enemy, and one which can help land you in jail for obstruction of justice.

Given how bitterly Eric Holder has fought the release of Fast and Furious documents over the last several years it's pretty easy to guess that the Vaughn Index is going to be no friend to Holder, the DOJ or the Obama Administration in general.

Is there any way to insure that the Vaughn index is accurate, and not an “aggressive” interpretation of the documents that amounts to lies?

That’s what I thought. The judge is forcing them to release the “list” of Fast and Furious documents, not the documents themselves. But I guess that will lead to the documents eventually. Given that Obama wrapped this whole deal up in Executive Privilege, I would suspect where there’s smoke, there’s fire. Obama and Holder are hiding something that will implicate them.
