NC magistrate refuses to marry gay couple (faces removal or suspension)

A state magistrate in Pasquotank County could face disciplinary action after refusing to marry two men following the end of North Carolina's gay marriage ban.

Magistrate Gary Littleton declined on Monday to perform the couple's civil ceremony, citing his religious views that marriage should be between one man and one woman. Under state law, a magistrate who fails to perform his or her legal duties can face removal or suspension.

Wrong citation. He should simply point out that marriage is defined as being between a man and woman so the requirements weren't met.

I don’t know that I want government officials determining whether to obey a law or not. If he were to argue that it is not settled law, I can see that.
But I don’t want a Muslim magistrate deciding that it is OK for a Muslim man to beat his wife.

Pretty soon it won’t just be a magistrate or judge that will face religious persecution.

It’ll be a priest, minister, rabbi (but NOT a muslim cleric) that will be banned, fined, or even jailed for refusing to “uphold the law”.

they were married by a different magistrate and didn’t file a complaint. Littleton had notified the court of his intention to retire before all this came about and the judges are going to protect him, IMO. The sodomists married were not local and NC and VA newspaper articles did not say where they were from - poor writers.

...no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.

An easy accommodation is simply to have a magistrate with no objections perform these contracts. Being a magistrate involves a lot more than just marrying.

Two people of the samesex cannot marry. Marriage is when opposites become one.”Samesex marriage” is the samething as calling a dog’s tail a leg and then saying a dog has 5 legs.
The Magistrate is correct.

It is unconstitutional to require a religious test to perform a public office. There are far easier accomodations than firing people or forcing them to retire. What if he weren’t retirement eligible?

And will they publish “Must have no religious objection to gay marriage/polygamy/bestiality/incest” as a job description?

The magistrate is correct, and those who seek to fire him are in violation of our God given rights not to have our religion held against us.

Like it or not when you sign up for these posts you are required to follow the law. If you don’t like the law resign or get it changed.

Just like a pharmacist who doesn’t want to sell the morning after abortion pill. If you sign on with an employer who sells the pill you can be fired for not doing what your employment requires.

How many county clerks or magistrates have resign rather than issue gay marriage licenses or perform ceremonies. I would think a small handful.

A couple of things:

1. They just had a federal court rule against North Carolina’s ban on homosexual marriage. This man was in the position for years and perfectly legal until last week. IOW, the law changed. He didn’t. In fact, the law didn’t change. It was overthrown by a judge.

2. He has a right to free exercise, to not be prevented from holding an office because of a religious test, and to have all the protections in any state as he does federally.
