Crimes of Exactly What? [VDH]

The recent unfortunate shooting of Michael Brown in Ferguson, Missouri, and its violent aftermath seem to have had everything and nothing to do with race. Brown was black and unarmed and the officer white; but it is equally true that the 292-pound Brown likely committed a number of crimes in the minutes before his death. He was high on drugs; he robbed a store and strong-armed the clerk; he was walking down the middle of a road; and he started a physical altercation with policeman Darren Wilson (who tried to question him), inflicting injuries on the officer before being fatally shot. If that were a typical day in the life of an American citizen, then civilization, as we now know it, could no longer exist.

So far, evidence both released and leaked suggests that Brown most likely tried to grab the officer through the police car window, prompting a struggle over his gun — which was fired into the patrol car twice — began to run away, and then was shot as he turned and charged.

There is no evidence so far that Brown was either shot in the back or shot while his hands were up, surrendering to the officer. Legitimate questions, of course, remain about many of these details of the shooting of an unarmed suspect, and eyewitness accounts are conflicted; but so far no forensic evidence suggests an execution-type police shooting.

No matter. Ferguson is supposedly now iconic of white institutionalized racism and police brutality, a teachable civil rights moment, as it were, that is currently being used by Democratic candidates to galvanize the African-American vote against Republican candidates. So much so that everyone from Eric Holder and Barack Obama to Elizabeth Warren and Ruth Bader Ginsburg has described the shooting or its violent aftermath ...

VDH is pissed. The POTUS and his AG are worse race-baiters than Sharpton/Jackson and he has called them out on it. Big time!

And thus the ridiculous notion of pacifying the Blacks by electing a non-Black, totally unqualified, un-American to the highest office. By the whites.

Give in once means you will be given in all the times down the road. Any parent can tell you that.

No evidence of Blacks, lofo, and white trash are mollified.

There is evidence. The shot that struck his right arm, inside, above the elbow.

When a person runs away - particularly a heavy-set person - their arms often “chicken wing” out some, to the side.

It would be, probably that shot fired by P. O. Wilson, that caused perp. Michael Brown to flinch, stop, and turn around to face Wilson.

Maybe. But he describes the path as “upward, backward, and leftward”, and it’s in the middle of a pretty classic series of shots for someone shooting rapidly at an approaching threat.

I don’t know what the law is in Missouri about shooting after someone fleeing — some places, some circumstances, a cop has the legal right to shoot someone who is running away. But just about everywhere I’ve looked into it, if a cop feels justifiably threatened, he has the right to shoot someone approaching him. The law doesn’t care whether Michael Brown had his arms up or not; the very fact that he was moving in Wilson’s direction and refusing to stop means Wilson had the right to shoot.

Homicide rates for “unarmed” homicide (killing with just hands, fists, feet, etc.) in the US have been dropping — they were nearly three a day a decade or so back, I think they’re down to fewer than two a day now — but they still happen, and the law takes account of that. If it’s true that multiple witnesses have testified Micheal Brown was approaching Wilson, then it’s pretty likely that the law is on Wilson’s side.

I was writing about the shots placed by P. O. Wilson while chasing after Michael Brown -— both men going in the same direction.

One witness at least, states that P. O. Wilson fired 4 shots at Michael Brown as Michael Brown was fleeing.

The shot above the right elbow of Michael Brown, in particular, is what could cause Michael Brown to respond to the shot’s effect - tying in with observations made by known witnesses - and then Michael Brown stopped, and then Michael Brown turned to face P. O. Wilson, who kept moving toward Michael Brown.

“Could cause” - because of the enervation in that area of the inside of the arm above the elbow.

Yeah, the witness stories are all over the map on that. Not surprising; I’m sure it happened fast and witnesses tend to get confused.

According to Dr. Judy Melinek, the pathologist who analyzed the autopsy for the St. Louis Dispatch, the shot above the right elbow, along with the ones to the chest and head, were all from the front. It’s the shot to the forearm that has an entrance on the back, but that could also have been from the front, depending on how Michael Brown was holding his arm at the time.

Presumably the forensic pathologist who did the examination testified before the Grand Jury; I’m hoping that his testimony and the discussion there will give us some more information.
