Federal judge refuses government request to close terrorism hearing

A federal judge Friday refused a government request to close her courtroom for a hearing next week for a Bolingbrook teen charged with attempting to go abroad to join the extremist group Islamic State..

Prosecutors had asked U.S. Magistrate Judge Susan Cox to restrict access of the public and the news media during the Monday detention hearing for Mohammed Hamzah Khan because of "privacy concerns" involving two minors connected to Khan's case but not charged with any wrongdoing.

In her four-page ruling, Cox said prosecutors had not met their burden to show that closing the proceedings would outweigh the "value of openness" in the courts. The U.S. Supreme Court has found that court proceedings should be closed only in rare circumstances — and only when the government can "narrowly tailor" its request, she noted.

Good for the judge, closed courtrooms for criminal trials violate the Sixth Amendment:
Amendment VI
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

“War on terror” has sort of lost its meaning lately.

Did FDR call WW2 a “War on Sneak Attacks”? A sneak attack is a tactic, not an enemy. Dittos ‘terror’.

I do not understand why we want to stop these idiots from going over there. It seems that they are some of the first to be killed, and their “comrades” don’t mind using them as canon fodder. Let them go and get killed. Just don’t let them come back if they manage to survive. Good riddance.

Terrorism is a tactic, terrorists are people and that’s who we’re supposed to be at war with.
