The Emancipation Proclamation was legal due to Lincoln's executive powers as commander in chief. It was a war measure and constitutionally sound. When the war was ending, Congress passed a constitutional amendment to codify it in law. What Pelosi has admitted by her statement is that Obama is at war with the American people.
