Abbott, a Republican who takes office next month, met Obama last week shortly after he filed a lawsuit on behalf of states suing the administration over its executive order that eased the threat of deportation for millions of immigrants. …

Is he going to build a wall with these funds?

The Feds won’t do anything about the invasion, maybe Texas will?

"maybe Texas will"

That's a joke. The only reason Perry spent this border enforcement money was to enhance his chances in the presidential campaign.

Rick Perry and the Texas GOP should be paying for this.

Yes, you are right. The headline is completely deceiving and reveals a blatant bias by Reuters.

Here is the actual lawsuit complaint filing:

https://www.texasattorneygeneral.gov/files/epress/files/20141203ImmigrationExecutiveOrderLawsuit.pdf

From the beginning of the suit, its purpose is clearly laid out:

“... seek declaratory and injunctive relief against the United States and the above-named federal officials ... for their violations of the Take Care Clause, U.S. CONST. art. II, § 3, cl. 5, and the Administrative Procedure Act ...”

and:

“This lawsuit is not about immigration. It is about the rule of law, presidential power, and the structural limits of the U.S. Constitution.”

Specifically in “IV. CLAIMS FOR RELIEF” of the complaint there are Three Counts. The first claim cites a violation of the US Constitution as a violation Of The Take Care Clause, Art. II, § 3, Cl. 5, which is the President’s constitutional duty to “take Care that the Laws be faithfully executed.”. The second and third counts cite specific violations of the Administrative Procedures Act or APA.

None of the counts request federal funds and in fact nowhere in the legal complaint is there any request or allusion to the provision of federal funds.

Finally, the “DEMAND FOR JUDGMENT” requests the following:

Plaintiffs respectfully request the following relief from the Court:

A. A declaratory judgment and injunction that the Defendants’ deferred action program violates the Take Care Clause;

B. A declaratory judgment that the Defendants’ deferred action program is procedurally unlawful under the APA;

C. A declaratory judgment that the Defendants’ deferred action program is substantively unlawful under the APA; and

D. All other relief to which the Plaintiffs may show themselves to be entitled.

In the first demand, the complaint asks that a federal order be issued to stop the President’s ‘Executive Action’ and that a declaration be made by the Court that such action violates the US Constitution. The second and third demands ask the court to declare that such action violates federal law in regards to the APA. The fourth demand is standard legal verbiage included in all legal complaints.

In Sum, the lawsuit asks that the President’s action be stopped and declared unlawful.

No demand of funds is ever made. Issues of funds are only brought up in the required section on irreparable harm (III. FACTUAL ALLEGATIONS; Sec. G) amid myriad other harms especially as secondary to illegal smuggling of children and epic humanitarian crisis causation. No ‘demand’ for funds is made in the factual allegations nor made in the section that requests relief.

The count of states joining the lawsuit now stands at 20 and is growing.

I am one who believes in Amnesty, as long as the people work for it.

So this is my thought.

Have the illegals build the border wall. They will get paid, have food, water, medical and shelter provided during the project. At the conclusion of the project make sure that everyone who built the wall is on the Mexican side of it.

Now seal it off and deny you ever offered amnesty. Then blame Obama that he never signed the amnesty document.
