Alabama Chief Justice Ray [Roy] Moore Says Courts Overstepped on Gay Marriage

Chief Justice Roy Moore of Alabama, who tried to stop gay marriage there with a last-minute order, insisted Monday that the federal courts have overstepped their authority by ordering the state to issue same-sex marriage licenses.

"The U.S. district courts have no power or authority to redefine marriage," he told NBC News by phone. "Once you start redefining marriage, that's the ultimate power. Would it overturn the laws of incest? Bigamy? Polygamy? How far do they go?"

"A lot of states in this union have caved to such unlawful authority, and this is not one," he said. "This is Alabama. We don't give up the recognition that law has bounds."

Gay couples began marrying in Alabama on Monday after the Supreme Court declined to block a federal judge's order requiring Alabama to license same-sex marriages.

On Sunday night, Moore forbade state probate judges from issuing marriage licenses to same-sex couples. Marriages went ahead anyway, and at least one probate judge told NBC News that Moore's order was without merit. "I have a duty to follow the United States Constitution," said Judge Alan King of Jefferson County Probate Court.

Moore said that the federal rulings were invalid because the party representing the state, Attorney General Luther Strange, has no authority over probate judges, who issue licenses.

Since neither homosexuality or marriage is a legitimate federal concern (See US Constitution) they are subjects the states can legislate if they so wish.

I am sure the Supreme Court will clarify the issues /S

The Governor issued a statement that basically says he’s not going to do anything about any of it.

“This issue has created confusion with conflicting direction for Probate Judges in Alabama. Probate Judges have a unique responsibility in our state, and I support them. I will not take any action against Probate Judges, which would only serve to further complicate this issue.”

Fire the probate judges - and then fire this bonehead Governor.

The frightening side of “gay marriage” is that it shoehorns in discrimination against those who support traditional marriage, such as saying that a single mother who puts a baby up for adoption to a married two parent family can’t say it can’t go to two lesbians, or a man in a dress arguing that it has an equal right to using women’s bathrooms under the same “equal protections” arguments as gay marriage.

Yes, as another commenter has rightly said, this is not about same-sex "marriage" per se, but about normalizing perversion and removing any means whereby it can be limited or penalized under law.

If the probate courts don’t do their jobs, then state law still needs to be enforced. That’s where county sheriffs come in. The sheriffs can send deputies out to monitor courthouses and arrest any judges who violate state law.

I wish that the judges would reference constitutional clauses and supportive excerpts from the writings of founders like Thomas Jefferson, and also Supreme Court case opinions, to justify their stances on gay marriage. Then we’d know which judges are pro-gay activists trying to protect gay marriage.

In fact, based on how he failed to argue 10th Amendment for his Ten Commandments display, Judge Moore sounds to me like a “flag, motherhood and apple pie” patriot who really doesn’t know how to substantiate his assertions with the Constitution and its history.

So some 8 counties refused to open today.

This a lot different from the integration of schools in the 50’s/60’s.

Just what is going to happen to judges who refuse? Will they be disbarred when the Chief Justice agrees with them?

What is Zerohissef going to do if Alabama simply refuses? I guess cut off federal funds?

Interesting play here...
