I'd be surprised if the cop is charged with anything more than manslaughter or negligent homicide, though in New York City the prosecutors -- even the leftist ones -- can have a strange way of dealing with a case like this. Sometimes they'll go out and get a murder indictment that they know will never result in a conviction -- just so they can say they tried to throw the book at the guy, but failed.
I saw a headline somewhere to the effect that the Ferguson “investigation” about to come to an end. And since there are no coincidences in such matters...

Only the rookie cop had his gun out, and he killed the man as he was coming up the stairs with his girlfriend.
The rookie claims that his pistol went off.
As far as cops in a dim hall where people live, they carry high quality flashlights, and you can’t go into apartment buildings and kill people coming home anyway, regardless if a hall light is out.

i didn't say it was... in fact, my point is that it is a personal disaster... this shooting is not like the Michael Brown shooting where Michael Brown was at fault... this rookie messed up and unnecessarily took the life of someone who was minding his own business... tragic for the victim and for the officer, who knew soon after the incident that he would likely lose his job over this...
This is wandering a bit OT, but I can see where flashlights could be problematic. A perp who shoots a little to the side of the light source has about a 50% chance of hitting the person holding the light.
So...
It sounds to me like the police need something along the lines of an electrical flare. Modern LED’s and 3 AAA NiMh batteries (Or a Li-ion if one wants to spend a little more) can throw a good bit of light if you only need it to last 4-5 minutes.
Make the thing highly shock (impact) resistant as lobbing it up / down stairwells, into alleys, etc., would be a primary usage. An option to illuminate upon impact or after a short delay would also be useful.
Something like this already exists, but, 400 lumens for the strobe function is pretty wimpy. I’d expect the “constant” illumination function to be better than that...

Assault teams already have what they need.
Its an indictment which is nothing more than an accusation.
The trial will decide whether and what he’s guilty of.
Which is a good thing. Far too many of these cases don’t get to this point.
That’s how the justice system is supposed to work, not by police chiefs running interference or trying either the cop or the dead guy in the media.

To the deceased, with 24 previous arrests, all I can say is karma’s a bi**(*. Of course the inexperienced cop will also be paying the price for a dumb mistake.
That bears repeating, the armed city employees didn’t call the ambulance first, their first call was to their union rep.
