The most likely scenario is that neither cop even saw him well enough to identify him anyway.

It's a common practice in NYC housing projects for mutants to destroy the light bulbs in the stairways and rob people as they walk down the darkened stairs. It's hard to see anything at all, and anyone in the stairway has to be prepared for the worst. That's why NYC police officers always have their guns drawn when they're walking up the stairs in those buildings.

Maybe the cops should draw their flashlights as well.

To the deceased, with 24 previous arrests, all I can say is karma’s a bi**(*. Of course the inexperienced cop will also be paying the price for a dumb mistake.
