BREAKING: Ala. County Must Issue Same-Sex Marriage Licenses
Law 360 ^ | February 12, 2015 | Jeff Overley

Posted on 02/12/2015 2:16:21 PM PST by Lurking Libertarian

An Alabama federal judge on Thursday ordered the state’s second-largest county to begin issuing marriage licenses to same-sex couples, paving the way for other holdout parts of the state to fall in line.

The ruling from U.S. District Judge Callie V.S. Granade was directed at Don Davis, probate judge of Mobile County, the most populous of several dozen Alabama counties that had not complied with a same-sex marriage ruling that took effect on Monday. Granade’s decision may convince other probate judges to no longer heed an order from Alabama Chief Justice Roy S. Moore to continue refusing to issue same-sex marriage licenses.

"Probate Judge Don Davis is hereby enjoined from refusing to issue marriage licenses to plaintiffs due to the Alabama laws which prohibit same-sex marriage," Granade wrote.

More than 40 of Alabama’s 67 counties were withholding same-sex marriage licenses before Granade’s decision on Thursday. Three-fifths of the holdouts had stopped issuing any marriage licenses and two-fifths were only issuing licenses to opposite-sex couples, according to the nonprofit Human Rights Campaign.

Unless and until that very same judge “orders” constitutional open carry in Alabama, her ^opinion^ should be ignored. Constitutional rights are not to be a pick-and-choose assortment.

I may get struck by lightening some day for saying this, but I do not consider a homosexual right to heterosexual type marriage to be a civil right.

If they wish to register as a couple, I’m not against it. I don’t want them to have to lose property when a death occurs, or be denied access to a sick partner.

I just believe that heterosexual marriage was a Christian based ritual, and Christians don’t buy into homosexuality.

This is like the boys demanding access to the girl’s rest room so they can gape at naked girls. They don’t belong there. Homosexuals should not be able to hijack a Christian ritual.

If they are going to go against thousands of years of religious teachings and beliefs, they shouldn’t have grounds to demand to participate in a Christian ritual.

I believe that God will judge homosexuals as well everybody else. Many non-homosexual people will be judged and found wanting, so I’m not here to claim heterosexual purity as it relates to sin. We all know that isn’t realistic.

It’s not for me to punish or make the lives of homosexuals miserable. I’m willing to leave them well enough alone to live a long and happy life. Just stay out of my face with issues like this.

Develop your own sectarian ritual, and leave Judeo Christian marriage out of it.

It’s the activism by these people that has caused the heterosexual community to object to their desires. If they would simply quit being blatantly offensive, nobody would go out of their way to give them trouble.

I have some people I know who are homosexuals. We socialize from time to time. I’d like to think of them as friends, because they are decent people. They may not think of me that way.

I don’t dislike homosexual people. I don’t agree with their life-style, but it isn’t for me to judge.

Leave kids out of it. Quit trying to proselytize them. When they grow up and have made a choice which way they want to go in life, then approach them.

What is going on today is evil. Our kids are under assault. It’s just not right.

Many homosexuals will agree. The movement to “educate” children about homosexuality early in life is wrong.

I don’t even want young kids approached on heterosexuality. I consider that child abuse, so this isn’t exactly homosexuality centric with regard to this.

Seems pretty clear to me what marriage is and yet CA as well as other states have been ignored stating a constitutional amendment is not constitutional if that makes any sense.

This is radical activism which they have been pushing on the country since the 70’s.

:: Is it worth going to jail? ::

Who will arrest and incarcerate the alleged offender?

U.S. District Judge Callie V.S. Granade should be indicted, tried, convicted, and sentenced to hang for giving aid and comfort to the enemy.

Yeah, if they aren’t issuing ANY licenses, this judge’s order violates the 14th and tenth amendments.

Federal overreach.

End it.

sounds like a golden opportunity for Don Davis. I hope and pray he’s up to it and he gets the support he needs from the ala citizenry.

We have two countries today.

I just wish. I'd get away from Obama's country in a split-second.

Sorry, I meant the City Council in DC. The point being that DC has gay marriage, and not as the result of any federal court order.

This is directly contradictory to Alabama State Law, which provides that probate judges “May Issue” marriage licenses... never mind the other state law violations involving the homosexual angle.

Even the folks in Sodom and Gomorrah were not issued same-sex marriage licenses.

“Will the Feds go after over 30 Gov’s and state judges, no course not.”

They won’t have to. When the first one falls the rest will get in line.

sounds like a golden opportunity for Don Davis.

Davis's lawyer told the federal judge today that Davis didn't care how the judge ruled, he just wanted clarity on what he was legally supposed to do.

It sure seems that the fuse was lit in earnest after JFK was assassinated.
