WEBSTER CITY, Iowa —Opening statements started Tuesday in the trial for a man accused of killing his former girlfriend's 5-year-old daughter.

Prosecutors say 35-year-old Casey Frederiksen was watching Evelyn Miller for her mother in July 2005 when he sexually abused the girl and stabbed her to death. He is charged with first-degree murder and sexual assault.

Prosecutors say all the evidence points to Frederiksen as the person who killed Miller.

During opening statements, Iowa Assistant Attorney General Scott Brown told jurors this is a case about innocence shattered. He said Frederiksen had the opportunity and motive to kill Miller.

Brown says Frederiksen also had direct access to the Cedar River, where Evelyn's body was found.

Brown told jurors Frederiksen told investigators he was sexually attracted to Evelyn.

He said Frederiksen sexually assaulted Evelyn the night she went missing and her biological dad was going to pick her up the next day. Brown said Miller had obvious injuries, and Frederiksen didn't want her dad to see them.

Defense Attorney Aaron Hawbaker did not make an opening statement, but did call for a mistrial. The judge overruled that motion.

The first witness on the stand was Andy Christie, Miller’s father.

Christie testified that he knew Frederiksen since high school, and were best friends for a long time.

He said he planned to pick up Miller the night of her death on July 1, 2005, but found out she was missing.

JURY POOL SELECTED

Lawyers began questioning jurors Monday and narrowed a pool of more than 100 candidates to a panel of five women and seven men for the trial of Casey Frederiksen.

Miller's body was found in the Cedar River a few days after she was reported missing.

The trial is being held in Hamilton County because a judge granted a change-of-venue request to move it from Floyd County.

Opening statements are expected Tuesday, pending weather conditions.

It's been a long time coming but, little Evelyn Miller's killer may yet receive some justice in this life.

I guess I'm somewhat surprised the sonofabitch is still alive.

It’s always, ‘Mommy’s New Boyfriend.’ What part of this doesn’t ANYONE understand by now? How many more beautiful little souls need to die?

her biological dad was going to pick her up the next day

You mean her real father?

You mean the parent that, if she was in his care, she would still be alive?

THAT "biological" dad?

And we STILL can't get our state senate majority leader, the Harry-Reid-like Michael Gronstal (D), to allow a bill on the floor to reinstate the death penalty, even for heinous bastards like this.

I do not and never will understand such things.

I can understand how someone could feel such a compulsion, we don’t really get to choose our obsessions, after all.

But acting on them is beyond my comprehension.

I have two little girls, though they’ve gotten a lot bigger, and I have strong feelings for all little girls. However, those feelings are an intense desire to protect them.
