How is it. The burden of proof is on you. What government agency is suppressing their rights under 1A? The last I looked, the national SAEs are not a government agency.

The 1A says that GOVERNMENT can't suppress your speech and throw you in jail for saying stupid things the gov't may not like. SAE is a frat, not the gov't.

SAE is basically saying, "you are free to spew vile hatred, but you're not going to do it while representing our organization. So you're out."

Are these kids being prosecuted? No. Are their freedoms being taken away? Nope. They got thrown out of a private organization. Which is perfectly fine and legal.

Of course its a 1A issue. These young men are free to say whatever they want. And they did. And they won’t be arrested. No one will drag them away. But there are also consequences.

Go in and tell your boss what you think about him. You’re free to do so. Doesn’t mean there won’t be repercussions.
