Inherent Contempt

Congress has the authority to arrest and imprison those found in Contempt. The power extends throughout the United States and is an inherent power (does not depend upon legislated act)

If found in Contempt the person can be arrested under a warrant of the Speaker of the House of Representatives or President of the Senate, by the respective Sergeant at Arms.

Statutory criminal contempt is an alternative to inherent contempt.

Under the inherent contempt power Congress may imprison a person for a specific period of time or an indefinite period of time, except a person imprisoned by the House of Representatives may not be imprisoned beyond adjournment of a session of Congress.

Imprisonment may be coercive or punitive.

This was my question last week when the DOJ announced that they would not be pursuing a Contempt of Congress filing against Lois Lerner. There was nary a peep about using an Inherent Contempt filing as a viable alternative from Boehner et al. Matter of fact, the silence was deafening!

This was a perfect demonstration of the complicity of Congress in the ongoing corruptness in DC.

The Kabuki theater continues.

I have been posting this for a while now, I still hope that Rush or Hannity picks up on it and takes it NATIONWIDE. I know for a fact Rush visits this site occasionally. Short of a real powerhouse taking this to the people, I don’t see anything ever happening.
