The answer to your question is that Congress has abdicated its authority over the Executive Branch, they do not want it back, and they would therefore not remove a Commander in Chief who refused to carry out Congress’ legitimate, constitutional command to wage war.

That is incorrect. Bin Laden was born in Saudi Arabia to a wealthy family. He was also well educated, some of that education in the US, but he turned on the Saudi family, who were and are friends of the US, and was tossed out of his family and went to another country where he put together the men to attack the US. He totally funded those men and that attack.
I should have also written above that the reason he turned against the Saudi royal family was, they allowed the US to have an air base there and to Bin Laden that was treason, an affront to Islam and the Prophet and Allah, and for that reason he would attack the US.
