Dissenting Justice Antonin Scalia summed up his disgust with this ruling in a footnote on page 7 (note 22). He says, “If, even as the price to be paid for a fifth vote, I ever joined an opinion for the Court that began: ‘The Constitution promises liberty to all within its reach, a liberty that includes certain specific rights that allow persons, within a lawful realm, to define and express their identity,’ I would hide my head in a bag. The Supreme Court of the United States has descended from the disciplined legal reasoning of John Marshall and Joseph Story to the mystical aphorisms of the fortune cookie.”

Interesting note - he alludes to being "buyable" as a fifth vote, trading decisions across cases. IOW, he'd join THIS opinion in order to get a fifth vote on a different case.

That's the law for you. "Disciplined legal reasoning" and being willing to go against conviction (trading positions for that fifth vote) are mutually exclusive.

He could have left out the phrase "even as the price to be paid for a fifth vote." It's not necessary to make the point. Maybe this is his way of sharing a bit of inside baseball.

consider this.

It is no different than courts refusing to embroil themselves in fraternal membership expulsions.

Some Christian (establishment) churches will not marry ANYONE who is from another faith. Some organizations will not allow convicted felons.

Look at the USSC case where religious accommodation HAD to be made. Now carry this over to people issuing marriage licenses.

Since government does not matter except to a handful of deviants and way to many sellouts, maybe Hillary was right, what does it matter?

Rules and laws are not absolute. We no long have 3 branches o government. No checks and balances. Our representatives do not represent us. The USC is whatever a handful of barrackaucrats say it means.

What is stopping anyone from doing anything???

You can criticize the Christian right all you want, but surrendering one’s faith principle for political gain is not a viable proposition.

Horse Hockey! The Blacks and Hispanics have been doing just that for generations. The problem with 2008 and 2012 is more than just those that sat out voting this go round, it is the roughly 33% that sit it out EVERY go round. This nation needs as close to 100% voter participation as it can achieve. The tyranny of the liberal cities is crushing this nation and their exceptionally loud voice is intimidating the concervative, rural voter into not voting.
