He would be subject to both civilian criminal and military prosecution. Double jeopardy does not apply here. UCMJ can also have a death penalty for these charges.

I wasn’t suggesting that there would be double jeopardy.
But he wouldn’t be breaking any rocks if the proper
sentence had been handed down and applied.
