Birthright citizen ship only occurs when a parent is under the jurisdiction (legal jurisdiction, ie citizen) when the child is born.

Or at least that is HOW/WHY the 14th was written.

A legal immigrant also falls under the jurisdiction.

Interesting tidbit: Jindal’s parents were NOT here on immigrant visas when he was born, and he was never naturalized, either. In other words, Jindal is a citizen of India, not the United States.

Actually legal jurisdiction in this case probably means no other overriding jurisdiction. As in, not the citizen of any other nation.

I was always under the impression that the legal jurisdiction phrase was meant to exclude foreign nationals such as ambassadors and staff who reside here for diplomatic purposes but are under the jurisdiction of their home country.

The case above is the SCOTUS case on point about “immigrant” children.
There are a number of conditional “factors.”

Tell that to Fox’s Shannon Bream, who has been subbing for Megan Kelleythis week. She calls the end of the 14th amendment (which she said she learned in school), needed to be abolished, when responding to Trump. And she didn’t see that happening.

Judge Napolitano was her guest and he concerred.

It was actually written for the captured slaves who were enslaved in America so their children could be American citizens. The left lies about everything, the Clintons and all their supporters lie about everything, and are no good theives and scum to boot.

Yes, the parents must have allegiance to the U.S. for that kid to be a citizen.
