In 1798, the legislatures of Virginia and Kentucky declared the Alien and Sedition Acts illegitimate in their states and prevented the enforcement of these Federal laws. Will the governor of Kentucky or the sheriff of Rowan County prevent the enforcement of Federal law with respect to this Supreme Court decision? If they fail to do so, the county clerk becomes just another martyr.

Until someone in authority who has command of armed police forces stands up to the Federal government, this ruling and others will stand unchallenged. This is the theory of the lesser magistrate, that was invoked in pre-independence America to justify this country's secession from the British Empire.
