Jailed Kentucky clerk says issued marriage licenses to gay couples void

A Kentucky clerk jailed for refusing to issue marriage licenses asserted that any ones that are issued without her authority Friday to gay couples in Rowan County are void and “not worth the paper they are written on” because she didn’t approve them, her attorney said.

Kim Davis “has already been doing Bible studies with herself” in jail, her attorney Mat Staver of Liberty Counsel told reporters after meeting her behind bars. He said Davis is in very good spirits and is fully prepared to stay as long it takes to defend her religious freedoms.

"She's not going to resign, she's not going to sacrifice her conscience, so she's doing what Martin Luther King Jr. wrote about in his Letter from the Birmingham Jail, which is to pay the consequences for her decision," Staver said.

Staver said he’s preparing to appeal U.S. District Judge David Bunning’s contempt finding as one of several legal challenges on her behalf.

At least three gay couples received marriage licenses on Friday from one of Davis’ deputies, embracing and celebrating after repeatedly being denied before Davis was imprisoned on Thursday. Their attorneys, along with Rowan County Attorney Cecil Watkins, insist the licenses are valid.

Marriage licenses in Kentucky usually have the elected clerk’s signature on them, those handed out on Friday didn’t have any signature. The Rowan County attorney and the lawyers for the gay couples insist they are valid anyway. When the judge was asked if the licenses will be considered valid without Davis' authorization, he said it was up to the gay couples to take that chance.

The gay’s attorneys can insist all they want.

The laws of Kentucky say otherwise.

And if they say the laws have been swept away, then NO licenses are valid until law is codified by the State of Kentucky legislature to replace what was wiped away.

She is in jail because some stupid assed federal judge thinks he is higher than the almighty.

Also as an aside, if you read the SCOTUS opinions, there is nothing, repeat not a word that strikes down Kentucky, Michigan, Tennessee and one other state laws. It ONLY professes that the 14th Amendment gives the “right” to marriage and the states must abide. Soooo, if Kentucky still has laws on the books, they are still valid until changed to abide by the court’s “decree”. The courts can’t change existing laws, only interpret or strike down. Neither has yet happened. Until the legislative branch, state and federal, get off their duff and impeach these phsyco judges, they will continue to think they are the almighty.

It is the judge who is breaking Kentucky law and he mention he was above natural law in one of the first reports on this (guess he sees himself as a little god )

So are the righteous citizens of Kentucky picketing the judge’s court? They should be demanding his removal from the bench by impeachment.

Why does anyone have to obtain a license to get married is beyond me. Maybe the IRS needs this info. If that’s the reason then let’s get rid of the IRS:)

How do you prove that you’re married then?

Can two people simply say they’re married and then they’re therefore married?

Let’s take just one example...

You are Mr. X married to Ms. Y, social security by default, gives what you would have gotten upon your death to your wife. Should you die, how does Ms. Y prove that she is Mr. X’s wife?

This gets complicated if Mr. X is now living with his mistress Ms. Z for many years.

So, both Ms. Z and Ms. Y claims that his social security should go be theirs. Without a marriage license how do they prove their respective claims?

did Kim Davis violate the law and should she have been jailed? The answer is quite clear: Davis upheld the law, and the judge's order is unlawful and, indeed, criminal and tyrannical.

According to Kentucky Revised Statutes Chapter 402.005, marriage is defined as:

As used and recognized in the law of the Commonwealth, "marriage" refers only to the civil status, condition, or relation of one (1) man and one (1) woman united in law for life, for the discharge to each other and the community of the duties legally incumbent upon those whose association is founded on the distinction of sex.

The chapter also goes on to point out that Davis was right in following the law as to who is not permitted to receive a marriage license. 402.010 reads:



Degree of relationship that will bar marriage. (1) No marriage shall be contracted between persons who are nearer of kin to each other by consanguinity, whether of the whole or half-blood, than second cousins. (2) Marriages prohibited by subsection (1) of this section are incestuous and void.

The chapter continues in 402.020 to prohibit other marriages, including those between members of the same sex, spouses who are married and seeking another marriage without divorce and polygamy.

Finally, it is noteworthy that 402.080 states, "No marriage shall be solemnized without a license therefor. The license shall be issued by the clerk of the county in which the female resides at the time, unless the female is eighteen (18) years of age or over or a widow, and the license is issued on her application in person or by writing signed by her, in which case it may be issued by any county clerk."

So, Kim Davis has followed the laws of Kentucky and, I might add, the laws of God concerning marriage. Who then is the violator of law in this matter? First, the sodomites are the violators of these laws in their attempt to get a marriage license. Second, the judge in the matter is in violation of the law by ordering Davis to do what is unlawful.

Frankly, it seems high time the people of Kentucky stop protesting and start demanding that Judge David Bunning and members of the Supreme Court be impeached and that sodomites be held accountable lawfully for their criminal behavior. Like I've said before, if we would deal with the crime of sodomy lawfully, we wouldn't be at this crossroads where so many people are confused about marriage.

That is what the Supremes struck down very explicitly, that in so far as any law, specifically Kentucky and 3 other state laws that define marriage as only a man and women. I don’t agree, but that is how they ruled. Now does that mean other parts of the law are still valid. A question yet to be litigated.

Kentuckyians can be an odd bunch...they continually reelect Turtle Chin Traitor/Liar Mitch McConnell. He must be Really bringing home the PORK. Like maybe Mitch is bringing a bridge and train and an International Airport to Corban, Kentucky !!SHAME on Ky. !!!

I stopped reading the article, when they started writing about that anti-HaShem couple. One point: one anti-HaShem person said it was waiting to get miraged. Why didn’t it go to the next county?
The mirage licenses aren’t signed? Oh boy, everybody can get married! I guess group mirages are legal now in Rowan county.
