She sounds like an idiot if she was just a bystander and the bad guys were not shooting at her or anyone else. Did she even know why the suspect was being chased? lol..☺

She was not in fear of her life. If she cant control herself better than that, she shouldnt carry.Unless the vehicle was aiming toward her, she might be toast. Prosecutorial discretion may save her, but in ND, the shooter would be in a pickle.
In general the standard is one of in danger of 'severe injury or death'.
Even the police would have trouble justifying shooting at a fleeing suspect in a property crime.
