On October 13, a federal jury convicted Ishmeal Heru-Bey for obstructing the Internal Revenue Service and tax fraud. An officer of the District of Columbia police department, he had failed to file individual tax returns for eight years. Heru-Bey had improperly claimed deductions for the cost of buying uniforms and other unreimbursed employee expenses while on paid administrative leave from the Metropolitan Police department.
Convicted after a trial of five days, Heru-Bey faces a confinement of a possible maximum of three years plus a fine of $250,000. Hired in 2002, he was last employed by the capital police depart in August of this year.
Heru-Bey, who was formerly known as Jamal Adams, was indicted on tax charges in March. It was after that time that he also filed false individual income tax returns for years 2011 and 2014, claimed prosecutors, on which he fraudulently claimed deductions for such things as uniforms, dry cleaning, mileage and meals.
Prosecutors provided evidence that Heru-Bey was not entitled to these expenses since he was on leave during those years and had no police powers during that time. The resulting loss of revenue for 2005-2011, and 2014, was in excess of $90,000.
Heru-Bey will face sentencing in January 2016 before U.S. District Judge James E. Boasberg of the District of Columbia, who also presided over the trial.
The two Muslim officers noted that their suspensions cost them the ability to work special events and overtime.
In 2013, Heru-Bey joined fellow officer Adham Numair-El (a.k.a. Joseph Gibson) in a lawsuit against Washington Metropolitan police in Superior Court, accusing its officials of suspending them indefinitely for converting to Islam. The complaint, filed on February 1, 2013, claimed “The investigation and suspension of the plaintiffs was initiated and conducted by defendant McGuire because of the plaintiffs' religious affiliation and personal associations, statements of expression made by plaintiffs, and the plaintiffs' respective name changes.” The lawsuit cited Metro Police Chief Cathy Lanier, internal affairs agent James McGuire, and the District of Columbia.
The plaintiffs claimed that the defendants had acted “in retaliation for the plaintiffs complaining that their suspensions and the first effort to terminate their employment were acts of unlawful discrimination and violations of the plaintiffs' constitutionally protected rights.”
Both Numair-El and Heru-Bey converted separately to Islam and thus changed their names. While Heru-Bey obtained a new Metropolitan Police Department (MPD) identification card and badge under his new name, Numair-El claimed he was denied both documents. The latter also claimed that he lost his job as a part-time security officer when he lost his police powers.
Both officers said they were found not guilty of misconduct for protesting. However, when they returned to work, they were suspended again. They claimed that McGuire caused the Maryland Motor Vehicle Administration to investigate their driver's licenses, which bore their Muslim names. Both claimed that the police department sought to dismiss them “at the urging and direction of defendants McGuire and Lanier, because of plaintiff's religious affiliation and personal associations."
The two Muslim officers said that their suspensions meant that they could not work at special events, nor receive overtime pay. "Both plaintiffs have remained suspended (with pay but no overtime, no authorization to work part-time, and no ability to be promoted) for nearly two years since the trial board ruled in the plaintiffs' favor and without notice of any allegations against them,” the complaint said. In that suit, the pair sought reinstatement as well as damages totaling $16 million, for employment discrimination, civil rights violations and negligent supervision.
