Note: There are two ways to obtain citizenship at birth.

Both result in "natural born" and yes the US Supreme Court has looked at the meaning of being born inside and outside of the USA.

"Natural born" has to do with whether on not a parent can bestow "Citizenship" on you or not.

Nothing else matters.

All of these articles on what Trump or media says are worthless.

Neither one know what they are talking about.

Not according to Justice Scalia when it comes to the natural born clause. He, at least, considers that it may need to include being born on US soil.

If just ONE parent living outside the U.S. and married to a NON-American citizen spouse . . can bestow a ‘natural-born citizen’ status to a baby born in a foreign country, then can someone please tell me why Conservatives thought Obama was NOT legally qualified to be President?

I didn’t notice any freakish behavior from Walt . . and I am glad he posted about this. Hubby and I have been discussing it all morning and waiting to know how other Freepers felt about it.

What is shocking is this has been the law (codification of Natural Law for all the nitpickers) for sometime. Yet John McCain, as US Senator for a zillion years, does not know this. In his words is not a constitutional expert. Yet he very certain that anchor babies are US citizens. Funny how elite politicians can be experts one moment and a novice nitbag the next.

I don’t think it’s as easy as you make it to be, Walt. Quite frankly, it bothers me to see Ted’s birth certificate from Canada . . just as it would probably have bothered you to see Obama’s birth certificate from Kenya. It is hypocritical of you to support Ted . . if you didn’t also fully support Obama’s legal status to be President. Trump would be hypocritical if he hadn’t answered as he did when asked about Ted’s birth in Canada, since he was bold enough to ask to see Obama’s birth certificate. To not at least question the legality of a Cruz presidency seems suspicious to me. The bias of politics is clearly apparent.

Because his mother was too young to pass on her citizenship if he was born outside the United States. She needed to be 19, but was only 18.

Because they do not do their own research. What is not generally understood is that the theory that Obama was not Natural Citizen was based that his mother was a citizen and father was not. They claim the law did not allow for this this when he was born. My research found they were wrong.

BTW, I have cousins born and raised broad. The mom is a US born Citizen and the father a not a citizen. They are US citizens. They can extend citizenship to their children born abroad too, but I think this get more complicated...

So your are all for any pregnant female, from anywhere in the world who can get to the USA, should be able to bestow Citizenship on her child while citizens of the USA who are in foreign lands, for legitament reason, when a child is born cannot bestow Citizenship on their Child.

We are talking about what is legal in the USA.

Nothing else matters.

I just read the regulation, it seems my cousins’ children have to live in the US for five years. That is why they finally left that hell hole and moved to the US!

Any person born in Cannada, with parents from the USA, will recieve citizenship from both countries. At somepoint that person needs to surender one or the other. I believe TC surrendered his in 2013 or 2014 which is not critical as long as he has done it.

ParentS . . that IS plural . . who are citizens of USA.
Rafael Cruz, Sr. was NOT a U.S. citizen.
During the Obama debacle of his birthright status . . some Constitutional authorities thought Natural Born was a higher status meant only for President as opposed to Congress (Senator/Representative).

My opinion does not matter. Neither does yours. The Mark Levin and Ann Coulter viewpoints don’t matter, either.

All that matters, really, is how SCOTUS would rule. Two of the Justices have made comments that indicate how they MIGHT rule. Opposing viewpoints.

Scalia clearly leans toward Jus Soli but that doesn’t mean that is how he would rule.

No one knows the outcome and IT IS NOT SETTLED LAW.

Both Cruz and Obama are legally qualified to be President. Both are citizens by right of birth. Obama because he was born in Hawaii. Cruz because he was born to an American citizen.

There are only two ways to get citizenship. By birth, and by naturalization. If you have it by birth you are a natural born citizen.

Surrendering his Canadian citizenship was a political choice. It doesn’t affect his presidential eligibility.

So let a court decide.

Cruz was a natural born citizen of Canada and the United States ?

Scalia himself has said natural born most likely means born on U.S. soil or territory.

But conservatives now throw Scalia under the bus.
