But some have still wondered if Trump can be considered a “natural born citizen” as the Constitution requires since his mother, Mary Anne MacLeod Trump, was born in Stornoway, Scotland, thus giving her British citizenship at her birth in 1912. Donald’s father, real-estate mogul Frederick Christ Trump, was an American by birth in New York City in 1905.

Columnist Ben Smith at Politico jokingly wrote, “Trump’s mother, it should be noted, was born in Scotland, which is not part of the United States. His plane is registered in the Bahamas, also a foreign country. This fact pattern – along with the wave of new questions surrounding what he claims is a birth certificate – raises serious doubts about his eligibility to serve as president of the United States.”

While the Constitution itself does not provide a definition of natural-born citizen, those challenging President Obama have asserted that it requires not only a birth having taken place on U.S. soil, but also that both parents of the child have to be U.S. citizens at the time of the child’s birth. Only Obama’s mother, Stanley Ann Dunham, was a U.S. citizen when Obama was born, while his father, Barack Hussein Obama Sr., was a British subject, having been born in Kenya.


“Donald Trump is a natural born American citizen, above the age of 35 and a resident of the United States of America longer than 14 years,” declares Birthers.org. “He has provided sufficient documentation attesting to his place of birth, and upon research of his parents it is determined that they were both American citizens at the time of his birth. … There is no doubt that at his birth his natural allegiance for the United States of America was and still is unalienable. …

Where are Trump's moms naturalization papers? Was she a citizen when he was born?

I have seen people posting that BOTH parents must be citizens, and that the candidates must be born in U.S. controlled territories or in one of the U.S. States to be considered natural born citizens.

When will they get around to Rubio; neither parent was a citizen when he was born? You talk about a clear-cut case.

The bigger question is: Is he a natural born Conservative?

We need a Declaratory Judgment action.

Of course I’m only bringing this up to help Don. I like Don. But we can’t have this question out there for the general election.

If she was a citizen when he was born, then I would think that would be sufficient. The parent does not have to be a natural born citizen, just a citizen.

You could have one parent from Zimbabwe and the other from Mars. If you pop-out on American soil that makes you a natural born citizen. (SHOULD that be the case is a whole nother issue).

That is, if you buy into birthright citizenship, which most experts say is not really in the Constitution. Of course, those of us who can read and are not considered experts can arrive at the same conclusion by merely reading the amendment.

Not even the same thing. Both parents were citizens. He was born in the United States. That's as natural born as can be. There is no natural born criteria for parents so it makes no diff where they were born just that they were American citizens.

Doesn’t matter. He is against birthright citizenship. He needs to stand by his statements and if his mother was not a Us citizen, then he should be deported.

This is stupid! There is no parallel with the Cruz problem!

Trump was born ON US SOIL.

Ted Cruz was born in CANADA and wasn’t a smart enough lawyer to even know he held Canadian citizenship until 2014.

The time to ‘panic’ would be over the big LIE Cruz tells that he, as a LAWYER, didn’t know until 2014 that he held Canadian citizenship by virtue of being born there! Where is the intellectual curiosity on his part that he didn’t investigate this?

There are only two kinds of citizens: natural born and naturalized.

If you didn't need to get naturalized to become a US citizen, you are natural born.

All of Trump's comments about Cruz are therefore silly and uninformed.

That this principle still holds was recognized in Rogers v. Bellei, 401 U.S. 815 (1971) implicitly in the majority opinion of Blackmun, in which Chief Justice Burger, and Justices Harlan, Stewart, and White joined:

[O]ur law in this area follows English concepts with an acceptance of the jus soli, that is, that the place of birth governs citizenship status except as modified by statute [and] the [Supreme] Court has specifically recognized the power of Congress not to grant a United States citizen the right to transmit citizenship by descent.

Hope someone can counter this. I don't want Cruz out of the race, that would bring GOPe Rubio into second place. I either want Trump or Cruz but someone needs to put this to rest.

That is an oft repeated lie. Senator Ted Cruz was naturalized at birth by the statutory laws for naturalization.

Consular Affairs. 7 FAM 1150 ACQUISITION OF U.S. CITIZENSHIP BY NATURALIZATION. 7 FAM 1151 INTRODUCTION...
8 U.S.C. 1101(a)(23); INA 101(a)(23)) defines naturalization as “the conferring of nationality of a state upon a person after birth by any means whatsoever.” For the purposes of this subchapter naturalization includes:...
(5) “Automatic” acquisition of U.S. citizenship after birth, a form of naturalization by certain children born abroad to U.S. citizen parents or children adopted abroad by U.S. citizen parents.

To be a natural born citizen a person must acquire U.S. citizenship by the sole authority of natural law. That is why it is called “natural” born citizenship. The Constitution has no clause granting it the power to birth (natus) a natural born citizen. The constitution only granted the Congress the power to establish a uniform Rule for Naturalization, meaning the making (datus) of aliens to be “considered sa” or accepted as if they were actual natural born U.S. citizens in many but not every respect, right or duty.
