ANOTHER German Judge Decrees Merkel’s Migrant Policies Unconstitutional

The retired president of a German state court has accused chancellor Merkel of acting unconstitutionally, and of moving to build her own personal power at the expense of German democracy.

Judge Michael Bertrams, former president of the constitutional court of North Rhine-Westphalia said Chancellor Merkel had "gone it alone" over the admission of "hundreds of thousands of refugees into the country". Judge Bertrams may have seen the worst excesses of this policy, as his court sat in the same German state which was rocked this month by the new year's migrant rape crisis, which was first reported in its largest city Cologne.

Chancellor Merkel's approach to migration is so far removed from the will of people people there are now questions over whether her actions are legitimate, questions the judge in an interview with Die Kölner Stadt-Anzeiger.

German daily Die Welt reports the judge has referred to Mrs. Merkel as creating a "high-handed Chancellor-democracy", an obvious reference to the power-grabbing German Chancellor of 1933, Adolf Hitler.

Judge Bertrams wrote: "Quite apart from the actions of the Chancellor, it raises the constitutional issue of whether she was legitimately able to act alone at all. In our representative democracy all essential decisions - especially those with impact on the budget - are in the hands of elected MPs". The Judge wrote in his opinion is the Bundestag (German parliament) needed to be consulted on the deployment of a couple of hundred German troops to Mali for peacekeeping, "then it is certainly necessary whenit comes to receiving hundreds of thousands of refugees".

The Chancellor's decisions, he contends, are not only without democratic merit at home but are also unpopular with Germany's European allies, a fact that is "especially true after the events of Cologne".

Given the way all media lie we don't really know WHAT the German people think. Merkel MIGHT have been getting static about immigration for a LONG time. Their media are just as corrupt as ours.

Just an opinion.

Some Federal Court may indeed overrule him....a year or two down the tracks. By then it will be too late to reverse whatever destruction he unleashed upon us with his phone and his pen.

Clearly, there is a mindset of Socialist-leaning government officials all over the world that have never had the firm hand of discipline applied to them in their formative years.

I've always had some questions and reservations about ANYONE who wanted to be president/chancellor/whatever of a country. There HAS to be some tremendous ego working there.

No surprise whatsoever about Merkel's attitude. The first of the seven deadly sins is PRIDE. She's got her share of it. Both genders have it equally but it's often, but not always, manifested differently.

Been living here in southern Germany for more than three decades.

At the BIG concern where I work, erstwhile Gutmenschen ("bleeding-heart liberals") are openly calling for the miscreants and their ilk to be immediately shipped back out of Germany - in cattle cars, if necessary.

Such a statement (and especially the allusion to cattle cars - reminiscent as it is of that, um, recent unpleasantness) would have been unthinkable just a few years ago.

I have yet to hear anyone say a good word about the asylum-seekers (except for my 16-y-o daughter).

Well the Austrian anti-Semitic Hitler is LONG gone. He learned his hatred for Jews in lovely Austria. He didn't leave his homeland of Austria until he was 22 or 23 years old.

Germans have always said what they thought my (my opinion). They often think similarly but may act indendently at any time.
With the INTERNET going full blast, I wouldn't put it past the new generations to demand a stop to all immigration...except Ph.D.s, engineers, mathematicians and folks willing to clean toilets and wash dishes.

2. Your daughter is sixteen. She WILL see the world, do a lot of thinking and, my guess, change her mind.

3. My guess is that the American Embassy will be INUNDATED with asylum requests....OR those folks will enter Mexico/Canada and cross into the the U.S.A. illegaly and then get financial aid IMMEDIATELY, if not sooner.

Yes, I admitted that for the sake of "full disclosure," and I sincerely hope that it's "only a phase." But I've examined some of the "youth magazines" she's brought home from school (you know - the ones provided by the school, itself) claiming, e.g., that 20% of all Syrian refugees have "degrees from institutes of higher learning" or "comparable qualifications."

The simple truth is that it doesn't "cost" anything for young folk to make compassionate statements and thus seem (at least in their own minds) "superior" to their elders.

"Those folks?" You mean Syrians and other M.E. types... or Germans? Because my German colleagues are already starting to joke about "escaping" to the States.

Germany cannot be seen issuing another cattle drive based on a religion, even if this latest one is evil.
