Some years ago a district court judge issued a deportation order in sentencing and the administration (it may have even been the Bush one) challenged the district court judge’s jurisdictional authority to do it. Their argument was that only the administration’s immigration judges, who are not even Article III judges, have deportation authority. I think they won. Let’s watch and see how this one unfolds.
