Here is the sad news.He will nominate someone, but that nominee won’t be confirmed in 2016. Beginning in January 2017 until the new Congress is sworn in, a brief window will be open before Obama leaves office on 20 January, during which he can make a Recess Appointment. That appointment will then be able to sit on the court until the next Congress convenes in January 2019. The only recourse to remove that appointment before 2019 would be impeachment (highly unlikely).

The President nominates a candidate. The Legislature has to confirm. They don't have to confirm if they don't want to. And no one can “make” them confirm. Remember Bork? Will they bow down to the Emperor again? Probably. Very sad. And if they do bow down? Will their be any doubt that Republican and Democrat are the same party? I wouldn’t even schedule hearings until the Summer. That means NOBODY could even be seated until the fall, if then. If the Republicans can’t drag the hearings out into September then you know the fix is in.
