Attorney General turns up the heat in public war with Apple

SAN FRANCISCO (AP) -- The nation's top law officer called for dialogue with the tech industry, but also turned up the heat on Apple for refusing to help the FBI unlock an encrypted iPhone used by an extremist mass killer in San Bernardino.

"One risk is making this all about Apple when in reality it's about all of us," U.S. Attorney General Loretta Lynch told an audience at a major cybersecurity industry conference in San Francisco on Tuesday.

"We have to decide," she added. "Do we let one company, no matter how great a company, no matter now beautiful their devices - do we let one company decide this issue for all of us? Do we let one company decide this is how investigations are going to be conducted?"

I’m not sure what to make of this. My son works for Apple, and what they’re telling the employees is that they’ve decrypted phones before (with a court order), and are willing to do so in the San Bernardino case as well, but that the government is holding out, demanding a universal software tool where the feds can crack any iPhone on their own discretion. If that story is correct, I can certainly see why Apple is fighting it, but surely the court proceedings are public record, and it would be getting out into the public if that were the story. But OTOH, if they’re lying to the employees, you’d think that would come to light pretty much immediately as well. I can’t figure out what the real story is.

‘Do we let’? I mean, really, the hubris of government employees is reaching historic levels. Psst: WE LET YOU DO THINGS. That’s how this works; WE the PEOPLE grant certain powers to the government.

I was disappointed that Cruz sided with the gov’t on this one. But the way he explained it either he doesn’t have all the facts or he thinks no one else does.

The question is whether the government can compel a company to deplore a product that does not exist. If it gets to the SC, I say they will vote yes, since they have already ruled that citizens can be compelled to engage in commerce (ACA).

Apple is clearly within the law! What the goverment is trying to force Apple into doing is called “involuntary servitude,” and it’s illegal under the Constitution.
Now, you may not like Apple’s position, and that’s your prerogative, but you don’t get to rewrite the Constitution because it doesn’t suit your posltion. That’s what the RATs are always trying to do.

It seems to me Lynch is confirming what your son was told - they want something they can make the whole industry do.

I believe Apple, because they have helped investigations before, and the gov’t doesn’t want to just hand them that one phone to crack. They want a whole new program at their disposal. Also, they changed the password and then forgot it? Sounds suspicious to me.

I don’t think she is going to get a favorable response at RSA.
RSA is for tech professionals fighting internet infiltration both foreign and domestic.

They don’t respond to verbal threats.
They live fighting real threats daily.

The question is whether or not countries will continue to allow Apple to sell phones that cannot be cracked. Why should any country allow criminals and terrorists secret hiding places the govt can’t examine. Sorry but Apple is going to loose this one. They probably already have in China.

If I were Apple, I would develop the tool to retrieve the data. But I would NOT give the government the tool. Period. If the government wants the data, hand the phone to Apple, let Apple unlock and retrieve the data, then let Apple insure their tool is not handed to the government.
