Pennsylvania Judge Rules That Ted Cruz is Eligible to Run for President

A Pennsylvania judge has rejected an effort to kick Republican presidential candidate Ted Cruz off the state primary ballot, ruling that the Texas senator’s birth outside of the United States doesn't disqualify him from the ballot under the U.S. Constitution.

The ruling is the latest legal victory for Mr. Cruz on the eligibility question. So-called "birther" suits have been filed in other states, including New York and Illinois. The cases in those two states were dismissed on technical grounds.

Unlike the suits filed against Mr. Cruz in other states, the case in Pennsylvania Commonwealth Court resulted in a ruling on the underlying constitutional question. The judge, citing various legal scholars, agreed with Mr. Cruz that he's eligible to run.

You might be wondering why a state court - and not a federal court - is tackling the constitutional question about presidential eligibility.

There's no consensus in the legal community on the meaning of "natural born citizen." But some scholars, most notably Ohio State University law professor Daniel Tokaji, have observed that state court could be where a court action opposing Mr. Cruz's place on the ballot has the best shot of going somewhere.

Cruz supporters don’t be stupid take the bait....

This is like cheese on a trap.

It’s only there to convince Cruz supporters, in the vote coming this Tursday, that Cruz will net be disqualified by a shopped federal judge by the DNC and GOPe.

Trust me the DNC and GOPe will do it.

They are only using Cruz to siphon Trump votes.

We have already seen three of these articles of Judges saying this. It’s only there to bait you.

Of course you’d believe the media spin on push polls taken when everyone is attacking Trump and nobody else. Believe what you want as you see how your candidate throwing in with BLM and MOVEON affects him. That Traitor will pay at the ballot box and then Trump will eviscerate Hillary once the back stabbing Canadian is out of the way. Of course he’ll probably stick around to support Hillary and the dual citizens sycophants will probably support her too. I only hope they are honest and vocal about it so we can have a good purge of those supporting the Dem in the general. Need to water the FR Tree of Liberty now and then too.

Judge Dan Pellegrini made a grossly erroneous assumption and false conclusion. See:

Judge Dan Pellegrini wrote that a natural born citizen “includes any person who is a United States citizen from birth,” and ordered the state’s secretary of the commonwealth to keep Cruz’s name on the ballot.

Wong Kim Ark, 169 U.S. 649, 18 S.Ct. 456, 42 L.Ed. “A person born out of the jurisdiction of the United States can only become a citizen by being naturalized....” His decision is to be appealed to the State Supreme Court.
