On Monday, former Governor Mike Huckabee said that if the senator wants to fight these latest accusations about him, he should start by suing the publication. The governor even cited the lawsuit between Gawker and former WWE wrestler Hulk Hogan adding, "I think he’s got a terrific opportunity to file the lawsuit. And, that’s the way to fight some of this stuff."

Huckabee can not be that stupid to make legally equivalent the Gawker case and the Enquirers's "there are some rumors out there" story. And he is legal idiot if he reaqlly beleive his statement of "he’s got a terrific opportunity to file the lawsuit".

Why? I think Huckster has a point. What the Hulkster's case shows is that some courts and juries are more sympathetic to the notion that even public figures have a protectable interest in a private life. Twenty years ago, I think the spirit was more that everything was fair game. Whether the verdict stands on appeal - who knows? But the analogy isn't totally off-base.
