The rule is that the new rules get written at the convention mostly by the new delegates.
That is the basic rule. It isn’t changing.
But if you like the old rules, then you must like rule 40.
If you want to keep rule 40, then the Trump and Cruz delegates can insure that no one walks out of that convention with the nomination except one of the two of them.
It should clearly say that "these rules are valid for 2012" in the rules if they are temporary rules. It's confusing otherwise.
I think new rules should affect the next convention, not the current convention. Changing the rules after the candidates have spent time and money playing under the existing rules just seems wrong.
I like rule 40, only because it helps my candidate Trump and almost ensured he was the only candidate. I'm indifferent as to whether they keep it for future conventions.
If delegates really supported the candidate they were named for, it's unlikely they will do away with rule 40 for this convention. If the GOPe apparatus gets to named the delegates regardless of who won them in the primaries, then the GOPe has total control and the primaries are a farce. It's only a matter of how transparent a farce the GOPe wants it to be.
