Supreme Court Gives Win To Property Owners vs. Environmental Agency

A unanimous Supreme Court is making it easier for property owners to get their day in court against the federal government, with three justices additionally suggesting that some government claims of power over private property may violate the Constitution.

In an opinion written by Chief Justice John Roberts, the Supreme Court ruled 8-0 in Army Corps of Engineers v. Hawkes Co. that a landowner can sue an agency over its “approved” version of a “Jurisdictional Determination.”

We’ll find out in the coming weeks what the 8-0 ruling cost us. It is nice to know our rights and freedoms are horse-traded in the court.

Even the libs on the court can see this was a bridge too far.

This was a First Amendment violation.

If they had not ruled as they did the entire Clean Water Act could be thrown out as unconstitutional.

That is what this was about. Keeping the CWA in place.

I’d love to see a class action against FEMA for this flood insurance scam they’ve been pulling for the last ten years. Go after rural folks who live near creeks, while ignoring the ocean front properties and force them to pay. Some 80% of homeowners who spend the (potentially thousands of dollars) money to fight it successfully show their property is NOT in fact in a flood zone. I’m fighting this right now for a house that is clearly NOT in a flood zone (150 year old home, never flooded of course). Being able to sue for punitive damages would make me feel marginally better once my blood stops boiling.

I tend to agree.

These black robes almost never get a clear majority on what I consider many very cut and dried issues. But this one is unanimous?

Federal Judges don’t like being told to butt out of anything...even if it’s the Federal government telling them to butt out.

I think the libs joined it because it could BACKFIRE on them in the future.

I still remember, after all these years, what happened when James Watt took over Interior under Reagan. He immediately tried to unshackle the country from Carter’s abuses of property rights, and the first thing the libs did was RUN TO THE COURTS to slow him down - and it worked. If this opinion stood, then the claim of no judicial review could be used against them should Trump appoint someone like Watt.

Just remember, EVERYTHING the left side of the court does is political. We may never hear about it, but I’m CONVINCED elected Democrats have channels into the Court and control at least those 4 judges...if not Roberts too.
