I think a police officer DOES have a legal duty to stop assault if he is witness to it...
Do they not swear an oath to that effect when they take the position????
Follow the money. The courts are part of the king's realm, and if the courts go against the king, the king will find new judges. The principle of "the king can do no wrong" is the default for civil claims. The government can allow itself to be sued. See "1983" civil rights actions, which are named after the statute that creates the right to sue.
