Yesterday we wrote about an already troubling attempt by Senator John Cornyn to attach a dangerous amendment to the Senate's ECPA reform bill that would massively expand what kinds of electronic communications the FBI has access to (as we noted, the FBI already pretends it has access to this very info, so really this law would be papering over the FBI's illegal collection of this info). But there's another amendment, put forth by Senator Jeff Sessions, that is just as, if not more, troubling. It's basically creating a massive loophole in the 4th Amendment, saying that any and all basic oversight can be tossed out the second the FBI declares the situation to be an "emergency."...
As we've discussed, back in April the House voted unanimously to fix ECPA. And while the Senate has dragged its feet until now, it's disappointing to see Senators like Sessions and Cornyn now try to attach dangerous amendments to ECPA reform that basically destroy whatever good that is in there. Both of those Senators should be ashamed...

The entire U.S. Congress are traitors. They support Traitorobama and they’ve now admitted they’ll do nothing about Obamacare. They gang-rape the Bill of Rights. And they pass secret laws that Americans are not allowed to see but for which they can be prosecuted.
If a politician is an incumbent, he/she/it is hellspawn.
I’m sure there’ll be an exemption for communications going in or out of any mosk in America.
Here we all thought the Democrats were the anti-American party.
People keep saying we have a “two-party system”. I see a RepubliCrat Party; where’s the second one?
GOP-E has to be swept OUT of office, For Goodness’sakes!
You know, love Texas. Love everything about Texas. The only exception is the politicians. Every Texas politician is no good. If democrat, they are neo-Marxist globalist cronies, utter blithering idiots, loyal Mexican citizens, or baby killers with gusto.
If GOP, they are establishment tools who are globalists, loyal citizens of Mexico, friends of the banking establishment, and authoritarian control freaks who want to micromanage every aspect of life.
They flavor their authoritarian impulse with utter ignorance.
Think down the list, Lyndon Johnson, Sheila Jackson Lee who thinks we landed on Mars, abortion Barbie, Jim Wright, etc. OR, we get W or any other Bush. We get Cruz, we get Perry, we get cornhole Cornyn, we get DeLay the bug killer who wants to stop Trump “at all costs”.
Such a great state, and produces among the worst most un-American politicans we endure.
I’ve heard good things about Gov. Abbot.
Now, officers can bypass the traditional warrant requirement in TRUE emergency situations: They are walking down the street, hear blood curdling screams from your house, they knock, no answer, you bet they can and will bust in.
The problem with the amendment in question is that as far as I could tell it doesn’t define emergency well enough. If it said:”Emergency as used herein means a situation wherein imminent, large scale loss of life appears clearly likely. Imminent shall be defined as within 48 hours.”
I’d be fine with that. Otherwise, every friggin’ thing becomes an “emergency”, including that the police go off duty in 2 hours and don’t want to stay overtime to draft a warrant.

Perhaps they are elected in the hope that they won’t return?
the Republicans are pushing these things even harder than are the Democrats. The irony is that when the Show Trials begin, and they will begin- sooner with a Democrat being elected this year, and a bit later if Trump wins- the Republicans will be the first Defendants. They are allies with the Democrat Totalists now, hoping the crocodile will eat them last, but history shows that the first victims after the Massive Reordering and Cleanup are the allies who don’t nominally belong to the ruling party. After them come the direct members of the ruling party as the leaders fight it out to become The Leader.
I trust Sen. Sessions. He is a great senator and would be a great VP.
Couple of months ago, people here were clamoring for Trump to pick Sessions as his running mate. Guess that is now off the table.
I have too. I hope he doesn’t go the normal route of a Texas Gop and sell out. Honestly, I don’t think he will. He fought a good fight against abortion Barbie. And I cant prove it, but I just have a sense that something about being in that wheelchair has made him a trustworthy man.
I suppose it focuses a man in ways we don’t fully get unless we’ve been in it.
To be replaced by socialists?
“Perhaps they are elected in the hope that they won’t return?”
LOL,, you might be onto something. Send em to Austin with the smelly people. And if they are especially onerous, further away to DC.
I'm not. But may your chains rest lightly on you as you crouch to lick the hand that feeds you.
The Constitution has no language in the 4th amendment regarding emergencies or extenuating circumstances. It is clear and absolute.
“I trust Sen. Sessions. He is a great senator and would be a great VP.”
I wouldn’t trust him, or ANY politician. The best you can do there is to watch them issue by issue, day by day. ANY of them will sell you out in a minute.
like on this issue, sessions is wrong. The FBI can do anything they want electronically only in an “emergency”. This means they will mumble the sacred legal incantation “this is an official emergency” whenever they want to do something. And an “emergency” can last years, or even decades.
He screwed the pooch on this one. But I think he is generally ok.
Clam down. LEO will still need a judges order regardless of what the article says.
