We have already reached the point where a large number of people are ready to restrict the Supreme Court to its Constitutional role of deciding case or controversies, not making law for the whole nation or voiding State laws.
The provisions of the Constitutional are straightforward. All legislative Powers herein granted shall be vested in a Congress of the United States . . .. Article I, section 1. Since all legislative powers are vested in Congress, that means no legislative powers are vested in either the judiciary or the executive.
Legislative power is the power to make, amend, alter, and repeal laws. Since no legislative powers are vested in the judiciary, the judiciary may not make, amend, alter, or repeal laws. The Supreme Court is only empowered to decide cases and controversies between the parties to a lawsuit.
